All Products on this Website are sold subject to the terms and conditions set out below. Nothing mentioned in these Conditions affects your statutory rights.

In these terms and conditions, the words below have the following meanings:
“Conditions” means these terms and conditions.
“Website” means the Ruth Tomlinson website, www.ruthtomlinson.com.
“Product(s)” means any Ruth Tomlinson product(s).
“We”, “us” and “our” means Ruth Tomlinson Ltd.
“You” and “your” means the customer.

Ruth Tomlinson Ltd is a company registered in England and Wales with company number 7185016. Our registered address is 10 Hatton Place, London EC1N 8RU. Our trading name is Ruth Tomlinson, our VAT number is 906062056, and you can contact us at info@ruthtomlinson.com

ORDERS

Your order becomes binding as soon as we have accepted it. All orders are subject to the “availability” detailed on the individual Product pages within this Website.

You are responsible for checking and confirming that all details and aspects of your order are correct and suitable for your requirements, including, but not limited to (where applicable), ring size, gold carat, bracelet size, and delivery.

We reserve the right to refuse to supply any individual or company.

TERMS OF SALE

Our acceptance of your order brings into existence a legally binding contract between us. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts and as a result are the only people entitled to transact through this site. Any other individuals who are unable to perform legally binding contracts are prohibited from ordering goods using this site. If you do not qualify, do not use this site.

After placing an order through the site, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we reserve the right not to accept an order if we see fit, in which case the amount paid will be refunded in full via the original means of payment. This process also applies where orders are placed by telephone or other Distance Sales.

PRICES

Prices are correct at the time of publication. From time to time prices will change in relation to the gold price, and fluctuations in material costs - We reserve the right to review prices at any time.

Orders will be processed at our published prices, otherwise, in the case of any unexpected change in price, you will be informed and asked if you wish to reconsider your order before proceeding. All quotes provided by Ruth Tomlinson Ltd are stated in British Pounds Sterling £GBP and are valid for 30 calendar days, after which a revised quote can be provided on request. 

If you are purchasing from outside the UK, currency exchange rates and credit card charges may make a difference to the amount billed on your credit card. Import duties or tax costs will be invoiced to you directly from FedEx or DHL. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion.

PAYMENT METHODS

You may pay using Visa, MasterCard, American Express, PayPal and Shop Pay. You confirm that the credit or debit card being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

DELIVERY

We can ship our jewels worldwide. Although we can work to estimated delivery dates, we are unable to accommodate specific delivery time or date requests.

Products must be signed for by an adult on delivery. If any damage to the package is identified, it must be reported to us immediately.

All orders outside of the UK will incur import duties and taxes which are the sole responsibility of the customer. UK VAT will be deducted from international purchases, however local taxes will be applied on import. Any sales that are transacted in the UK (including collecting your jewels from our address) will incur UK VAT.

RETURNS & EXCHANGES

We hope that you will be absolutely delighted with your jewellery. If for any reason you are not entirely satisfied with your purchase, we are happy to offer an exchange or credit note within 30 days of purchase. Alternatively, we will refund a sale made through this website if it is returned to us unworn, in perfect condition, and in its original packaging within 14 working days of your receipt of the order. Purchases exempt from both the refund and exchange policies, unless they are structurally faulty, are:

— Commissioned pieces 
(bespoke, custom and resetting)
—  Engraved pieces

All sales are final for any items purchased at a discounted rate and no exchanges or refunds will be made on discounted items.

To return an online purchase, please contact info@ruthtomlinson.com for further details. Please include your order number in the email.

Ruth Tomlinson Ltd. does not accept any responsibility for any items lost, stolen or damaged in transit. These responsibilities are those of the customer. We recommend that UK items be sent by insured special delivery, and international items be sent using a secure and swift fully tracked service.

Please note that the cost of shipping is not refundable. In the interests of fraud prevention, your refund will be issued by the same method by which you paid.

If you are not based in the UK and would like to return an item, please note that a customs declaration form will be required on shipping. The goods will need to be correctly detailed as ‘RETURNED BRITISH GOODS’ in order to ensure that no additional customs fees are incurred on re-import to the UK. In the instance that an item is incorrectly marked and a customs fee is incurred, this may be passed onto the customer. This may also delay the returns process.

UNIQUE PRODUCT FEATURES

Each piece of Ruth Tomlinson jewellery is made by hand. This means each piece is unique and therefore small variations will always occur in the creation process. This can result in small differences from photographs of items in stock. Stone and metal colours may vary slightly and sizes are accurate within reason.

Please also be aware that variations in monitor, browser or software calibrations on your browsing device (mobile/computer) may cause variations in the colour of items shown digitally.

OUR WARRANTY

All Ruth Tomlinson jewellery is hand crafted in our London Atelier, and can be repaired in the event of damage. Manufacturer's defects are covered up to 12 months from the date of purchase. This does not account for general wear and tear, and we are not responsible for any loss that occurs.

Should an issue be determined to be a manufacturing fault within the first 12 months after purchase, Ruth Tomlinson will not charge for the repairs involved. If pieces are misshapen or show signs of damage from general wear and tear or improper care, these repairs will be quoted on a case-by-case basis regardless of age. 

Any work carried out on Ruth Tomlinson jewellery by another jeweller will void the warranty.

GIFT VOUCHERS

Ruth Tomlinson gift vouchers are available in values ranging from £100 - £2500. Our gift vouchers do not have an expiry date.

Our gift vouchers cannot be redeemed or exchanged for cash. They are non-refundable and can only be redeemed at www.ruthtomlinson.com or at our London Atelier using their unique code. They cannot be redeemed at any of our stockists.

ARCHIVE SALE

Purchases of items from our annual Archive Sale cannot be returned for a refund nor exchanged for another item of jewellery or credit note. Items purchased from our Archive Sale are not covered under Ruth Tomlinson's 1 year warranty. Repairs will be assessed on a case by case basis. Shipping charges apply to orders from the sale. Deliveries to the UK are charged at £10 International delivery is £65.

INTELLECTUAL PROPERTY & DESIGN RIGHTS

Design Rights and Copyrights remain the sole property of Ruth Tomlinson Ltd. Your use of this website and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to its content. Any reproduction or redistribution of the aforementioned content is prohibited and may result in civil and criminal penalties.

OWNERSHIP

This website is an official website of Ruth Tomlinson Limited. The copyright and the database rights are owned by Ruth Tomlinson Limited. The website and all intellectual property rights (including but not limited to rights in the website as a database) in its text, design, graphics, and the selection, organisation and arrangement thereof, together with the Ruth Tomlinson trademark logos and trade names depicted on the website, belong to Ruth Tomlinson Limited.

LIMITED LICENCE & RESTRICTIONS

You acknowledge and agree that the material and content contained on the website is made available to you for your personal and non commercial use. You acknowledge and agree that any other use of the content of the website is strictly prohibited and you agree that it is strictly prohibited to (or to assist or facilitate any third party to) copy, reproduce, transmit, modify, publish, display, distribute, commercially exploit or create derivative works of material and/or content from the website without our written permission and that any of the above is a violation of our intellectual property rights.

Unless specifically provided, we make no representations whatsoever about any other websites which you may access through our website or which may link to our website. When you access any other website, you understand that it is independent from us and that we have no control over the content or availability of that website. In addition, a link to another website does not mean that we endorse or accept any responsibility for the content or the use of such a website and shall not be liable for any loss, damage or offence caused or alleged to be caused by or in connection with the use of or reliance on any content, goods or services available on or through any other website or resource. Any concerns regarding an external link should be directed to its website administrator or web master.

DATA PROTECTION, PRIVACY & SECURITY

We will respect the privacy of your personal data and will comply with all relevant and current data protection legislation. We will not disclose your personal data to anyone, unless required to do so by a court of competent jurisdiction.

If you wish to update or delete your personal information, or if you prefer that we do not include you on our email newsletter subscription, please either unsubscribe directly on the email or contact us for assistance on info@ruthomlinson.com.

To proceed with your order, we need to process and store your personal information, and provide it to third parties who are directly involved with your order (e.g. our couriers). By placing an order with us, you agree to your data being processed by Ruth Tomlinson Limited and its couriers.

The purchase area of our website is fully secure. We utilise industry standard SSL (Secure Sockets Layer) technology to guarantee a safe and secure shopping environment. All sensitive information such as credit card details, names and addresses are encrypted. This means that information passed between your computer and our website cannot be read, even in the event it is intercepted by someone else.

BUSINESS/TRADE CUSTOMERS

These terms and conditions only apply if you are dealing with us as a final consumer. Our wholesale terms and conditions (both UK and Rest of World) can be requested directly from our wholesale team on wholesale@ruthtomlinson.com

FEEDBACK & COMPLAINTS

We always welcome feedback from our customers as it enables us to improve our service. If we should receive a complaint about any part of our service, by phone, email or letter, then it will be dealt with promptly. Please contact us on info@ruthtomlinson.com

REPAIRS & RECONDITIONING

Organic imperfections are part of the essence of the brand however, if you feel your piece has a structural fault, please return it to us for a full inspection. Please note, if the jewellery has been worked on by another jeweller this voids the repair warranty.

Repairs are assessed on a case-by-case basis and quoted depending on the complexity and scope of the repair required. Please get in touch if your jewellery requires a repair or reconditioning service. If a ring has been sized based on a measurement provided by the client,  Ruth Tomlinson Ltd is not responsible for the correct fit of the piece, only for pieces where we have directly measured you in our London studio.

We assess repairs on a case-by case basis. The wearer is responsible for the aftercare of their purchase. We are committed to making you as a customer happy so please contact us via email as soon as possible if you experience any issues with your purchase.

To comply with the Modern Slavery Act 2015, we have reviewed our existing practices, policies, and processes. This review aims to identify any risks of modern slavery and human trafficking within our operations and supply chains, ensuring that no such exploitation occurs.
